SportQube Limited (referred to in this policy as “SportQube” “we”, “us” and “our”) provide a software-as-a-service platform which saves and stores footage to segment into clips and has the option to use artificial intelligence (“AI”) to provide insights and information on sporting performance to organisations such as football, lacrosse, rugby, field hockey, ice hockey, Australian rules football and more.

We are committed to providing our services to organisations such as sports clubs, teams, scouts and the parents of the Users who run the sports club and teams (“Business Customers”) that meets the needs of our:

  • Business Customers;
  • the representatives of the Business Customers (“Customer Representatives”);
  • the end users of the Services such as sports players whose personal data is analysed (“Users”);
  • individuals who visit our website (“Website Visitors”) available at https://www.sportqube.co.uk/ (our “Website”); and
  • • individuals who visit and use our Platform by way of delegated access that the Business Customer and/or Customer Representative has provided (“Platform Visitors”) available at Olicam.co (“Platform”).

The Services use the information that is collected by video recordings which can be uploaded onto our Platform. There are various packages we offer Business Customer’s – for example: one is to use the Platform to simply save and store footage to segment into clips while another package uses AI to deduce certain statistics from the video footage. These statistics are generated per User at individual level and in aggregate form at player, position, team and other group levels to help inform Business Customers and Users.

This Privacy Policy describes how we collect and process your personal data and applies to personal data held about:

  • Website Visitors and Platform Visitors (collectively “Visitors”);
  • Customer Representatives; and
  • Users of our Services.

2. WHO WE ARE

We are the data controller in relation to the personal data that we collect, use or hold about you and we are responsible for protecting it in line with data protection laws. 3. Children’s Personal Data

To collect and process the personal data of Users for the Platform and Services, we rely on the Business Customer and its Representatives seeking consent from the Users – such consent is optional.

Usually such consent is requested by the relevant safeguarding or welfare officer for the club or another senior member of staff of the club and this is requested at the start of the relevant sporting season once match fixtures are confirmed.

Users have the right to withdraw consent at any time without affecting the lawfulness of the processing based on the consent before its withdrawal. In such instances, we take measures to ensure our Services and Platform do not capture the personal data of such Users who have not provided their consent such as by blurring the images of the Users in video footage and only using the statistics deduced from the video footage in aggregated form rather than at an individual User level.

As such, we may process the personal data of children under the age of 13 and over the age of 13. This is because they may be Users – i.e. sports players whose personal data is analysed on the Platform when video recordings are uploaded.

In line with the UK GDPR, if the child is over the age of 13, we rely on consent from the child to take part in the video recording and their personal data being collected for the Services.

If the child is under the age of 13, we rely on consent from the child’s parent or guardian to take part in the video recording and their personal data being collected for the Services.

4. Third-Party Websites

Our Website may contain links to third-party websites, plug-ins and applications. If you follow a link to a third-party website, please note that this privacy policy does not apply to those websites. We are not responsible or liable for the privacy policies or practices of those websites. 5. How and when we collect your personal data

We collect personal data about you from a variety of sources, including:

  1. from you directly. For example: when you are a User of our Services, a Customer Representative or Website Visitor or Platform Visitor that contacts us for support, have a query about our Services or our business in general;
  2. from information we generate about you during our relationship with you. For example: when you are playing a football match or training on a pitch, when you as a User use our Services and when you visit our Website and/or Platform and personal data is collected from cookies and other similar technologies such as Hubspot and Google Analytics which are described in our Cookies Policy;
  3. from information we collect about you from other sources, such as, third parties who supply the parts or manufacture the devices we use to provide the Services such as the video camera that we or a Business Customer purchases for video footage to be uploaded to the Platform Google and social media. This includes commercially available sources too, such as public sports teams and league databases (where permitted by law).

6. What we collect

We collect the following personal data from you directly:

  1. Personal details and contact information: you may provide us with personal data when you inquire about us. This may include your first name, last name, title, company name, address, phone number, email address, log in details for the Platform including security measures such as 2-factor authentication and information contained in the correspondence (which could tell us something about an your preferences).

We collect the following personal data generated during our relationship with you:

  1. Technical information collected from video recordings: This may include information deduced from the data that video recordings collect at individual User level and in aggregate form at player, position, team and other group levels. The data collected will vary and depend on the sport that is being played due to differences in game structure, player movement patterns and scoring dynamics as well as the Business Customer’s choosing the types of data it seeks to collect that would be most useful to the Business. For example, in football, the video footage of the game is filmed to determine how many passes are made, meters run, shots on goal, fouls etc. whereas in ice hockey which is fast paced due to the skates on ice, the video footage of a game is filed to determine speed, acceleration, frequency of substitutions etc.
  2. Technical information collected from your computer or other device such as smart phone: This may include your IP address, location (by country, state or city), device type, browser type, operating system, access data in server log files (such as date and time of the access, requests made, the amount of data transmitted and the requesting provider). We may also capture other information about visits to our Website and Platform such as usage and traffic patterns including pages clicked on, duration of visit, scrolling and monitoring errors.

We collect the following information from other sources, such as:

  1. Business Customers: we provide our Services to our Business Customers. These are organisations such as sports clubs, teams, scouts and the parents of the Users. As such, the personal data of the Users such as players is often received from the Business Customer such as the teams and clubs. This includes when a Business Customer purchases a device such as a video camera to upload video footage to the Platform.
  2. The third party providers of devices such as video cameras: This may include third parties who supply the parts or manufacture the devices we use to provide the Services such as the video cameras that we or a Business Customer purchases for video footage to be uploaded to the Platform– for example, a competitive football match between two teams during which the players are filmed. The video footage is uploaded to the Platform to deduce analysis such as speed and movement tracking to determine how many passes are made, meters run, shots on goal, fouls etc.
  3. Publicly available information: this includes Google, social media and commercially available sources too, such as public sports teams and league databases (where permitted by law). This may be to help us provide the Services as well as for identity verification purposes via Google and social media e.g. gender, country you are located in.

7. How we use your personal data and the legal basis on which we use it

To provide Business Customers and Users with access to our Platform as part of our Services, we use the personal data of Customer Representatives and Users. For example, to provide log in details to the Platform, email with updates to our Platform and Services as well as other uses in relation to providing access to the Platform and Services.

The Platform and the provision of the Services relied on the personal data of Users to deduce certain analytics and statistics on that Users performance. AI is used to help facilitate this Service, for example: by using the video footage of a football match, AI can track the action on the pitch automatically, capturing multi-angle footage such performance data to generate analysis and statistics along with other metrics.

To provide Business Customers and Users with access to our Platform as part of our Services, we use the personal data of Customer Representatives and Users and we do so in accordance with:

  • our contractual obligations to the Business Customers; and
  • our legitimate interests to provide a Business Customer, Customer Representative and Users with access and support to the Platform and our Services.

To collect and process the personal data of Users for the Platform and Services, we rely on the Business Customer and its Representatives seeking consent from the Users – such consent is optional. This helps us to understand how our you use our Website and Platform so that we can develop and improve the design, layout and functionality of the sites.

8. Use of Artificial Intelligence (AI) in selected Services

Our Services are provided in various packages. Some packages do not include AI while others do include AI which is used to help facilitate this Service, for example: by using the video footage of a football match, AI can track the action on the pitch automatically, capturing multi-angle footage, the AI is able to track such performance data to generate analysis and statistics along with other metrics.

We do not rely on solely automated decision-making that would have significant affects on you. The personal data that is deduced from such video footage via our Platform as part of the Services for a particular package that the Business Customer agrees to, is reviewed by the Business Customer and its Representatives for their own purposes. For more information about how Business Customers and its Representatives use the personal data of Users on the Platform, please contact your relevant organisation such as the sports club you play for.

9. How and when we share your personal data

We may share your personal data with third parties under the following circumstances:

  1. To organisiations that help us operate and improve our business and provide our Services such as:
    • Our credit reference agency, who will check the details we give them against public and private databases and may keep a record of that check to use in future security checks;
    • Professional service providers, such as cloud service providers, marketing and research agencies, profile and behavioural analytics companies and Website and/or Platform hosts who help us run our business;
    • Law enforcement and fraud prevention agencies, so we can help tackle fraud; and
    • Governmental bodies and regulators to comply with our legal obligations.

  2. Business Customers
    • We share the personal data of Users that our Platform processes as part of providing the Service to Business Customers and Business Representatives. We rely on the Business Customer and its Representatives seeking consent from the Users – such consent is optional. In such instances, we take measures to ensure our Services and Platform do not capture the personal data of such Users who have not provided their consent such as by blurring the images of the Users in video footage.
  3. As required by law
    • Where required or permitted by law, information may be provided to others, such as regulators and law enforcement agencies.
  4. In the context of a transaction
    • From time to time, we may consider corporate transactions such as a merger, acquisition, reorganization, asset sale, or similar. In these instances, we may transfer or allow access to information (including personal data) to enable the assessment and undertaking of that transaction. If we buy or sell any business or assets, personal data may be transferred to a third parties involved in the transaction.

10. Cross Border Transfers of Personal Data

We transfer personal data all over the world as part of our business operations and in order to provide our products and services. Where we transfer personal data outside of the country or territory you reside in such as outside of the UK and the Europe Union, we either transfer personal data to countries that provide an adequate level of protection (known as an “adequacy decision” and determined by the European Commission or other supervisory authorities such as the UK’s Information Commissioner.

Where required, we have put appropriate safeguards in place to cover these transfers. For example, in the form of standard contractual/data protection clauses adopted by the European Commission or other supervisory authorities such as the UK’s Information Commissioner - for example in the UK, this is the International Data Transfer Agreement or UK Addendum.
